1. Background
XYZ.com is a digital platform dedicated exclusively to healthcare job listings and recruitment services. We connect healthcare professionals with job opportunities offered by various partnered organisations. XYZ – Enterprise Solutions allows business users to post job vacancies and manage recruitment responses through the XYZ platform.
2. Interpretation
Words with initial capital letters have meanings defined under the following conditions. These definitions apply whether the words appear in singular or plural form.
3. Definitions
For the purposes of these Terms and Conditions:
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.
- Account means a unique account created for You to access our Service or parts of our Service. XYZ platform has two types of accounts: Individual and Enterprise.
- Individual Account refers to healthcare professionals or job seekers who access and explore XYZ job listings and recruitment services.
- Enterprise Account refers to business or organisational users representing a legal entity or freelance professional using the Enterprise Dashboard to post job vacancies and manage recruitment responses.
- User refers to any account holder, including Individual Users and Enterprise Users.
- Individual User refers to any person using the XYZ platform or applications through an Individual Account to search and apply for healthcare jobs.
- Enterprise User refers to any organisational representative or authorised person using the Enterprise Dashboard through their Enterprise Account to post job vacancies and manage recruitment.
- Company (referred to as "the Company", "We", "Us", or "Our") refers to Medtrust.
- Country refers to INDIA.
- Content means text, images, videos, or other information posted, uploaded, linked to, or otherwise made available by You.
- Device means any device that can access the Service such as a computer, cellphone, or digital tablet.
- Feedback means feedback, innovations, or suggestions sent by You regarding the attributes, performance, or features of our Service.
- Products refer to job posting services and related recruitment services offered for sale on the Service.
- Orders mean requests by You to purchase job posting or recruitment services from Us.
- Promotions refer to contests, sweepstakes, or other promotions offered through the Service.
- Service refers to the Website www.xyz.com.
- Product refers to job posting services, recruitment tools, or any other goods and services offered by or listed on the Service.
- Aggregate Product refers to any job posting or recruitment service listed or posted by Enterprise Users through the Enterprise Dashboard.
- Aggregate Product Order refers to any job posting or recruitment service initiated by any user on the XYZ Platform which is listed or posted by Enterprise Users through the Enterprise Dashboard.
- Enterprise Dashboard refers to enterprise.xyz.com, accessible for Enterprise Users only for their organisational job posting and recruitment management.
- Terms and Conditions (also referred to as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
- Third-party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.
- Website refers to XYZ, accessible from www.xyz.com.
- You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
4. Terms and Conditions
Charges
If there are charges associated with any portion of the Services, you agree to pay those charges in the currency specified. Prices exclude applicable taxes, currency exchange fees, and Payment Gateway Charges unless stated otherwise.
Taxes are calculated based on your location at the time your XYZ account was registered unless local law requires a different basis. We may suspend or cancel the Service if we do not receive timely, full payment from you. Suspension or cancellation for non-payment may result in loss of access to your account and its content.
Using a corporate or private network that masks your location may cause charges different from those displayed for your actual location. Some transactions may require foreign currency conversion or processing in another country. Your bank may charge additional fees for such services.
Your Billing Account
To pay for Services, you will provide a payment method when signing up. You can access and update your billing information and payment method from your account.
You agree to permit XYZ to use updated account information provided by your issuing bank or payment network. You agree to promptly update your account information, including email and payment details, so we can complete transactions and contact you as needed. Changes to your billing account will not affect charges submitted before we act on those changes.
Billing
By providing a payment method, you:
- Represent you are authorised to use it and that the information is accurate.
- Authorise XYZ to charge you for services or content you use.
- Authorise recurring charges for subscription services until cancelled.
We may bill you in advance, at purchase, shortly after purchase, or on a recurring basis. We may bill for multiple prior periods at once if not previously processed.
Refund Policy
Unless otherwise required by law or specific service terms, all purchases are final and non-refundable.
If you believe you were charged in error, contact us within 30 days of the charge. No refunds will be given for charges older than 30 days unless required by law. We reserve the right to issue refunds or credits at our sole discretion. Issued refunds do not obligate us to provide future refunds.
For residents of Taiwan or Israel, purchases of digital content and online services are final and non-refundable as per local consumer protection laws.
Refunds for Aggregate Product Orders (job postings or recruitment services) are governed solely by the respective Enterprise User or their organisational policy. XYZ has no role in their refund policies.
Canceling Services
You may cancel services at any time. Canceling paid services stops future charges. You may continue to have access to the service until the end of the current billing period, depending on the applicable service terms.
Payment to You
If XYZ owes you a payment, you agree to provide accurate information promptly. You are responsible for any taxes or charges incurred. Payments made in error may be reversed or requested to be returned.
Price Changes
We may change prices at any time. For recurring services, we will notify you at least 15 days before the change. If you do not agree, you must cancel before the change takes effect. Fixed-term prices remain in effect for the agreed term.
Bank Account Payment Method
You may register an eligible bank account for payments. By registering, you authorise XYZ to debit your account for purchases or subscription charges in accordance with this Policy.
